These Terms of Service govern your use of the Powur Dial AI outbound calling platform. By creating an account or using the platform, you agree to these terms.
Powur Dial is an AI outbound calling platform that provisions tuned AI voice agents, dedicated Twilio phone numbers, A2P 10DLC SMS registration, and campaign management for storm-response and field-service businesses. The platform calls leads from your uploaded lists, qualifies prospects via AI conversation, and books appointments directly to your calendar.
By uploading lead lists to the platform, you attest that:
Powur Dial provides federal and state DNC list scrubbing as a courtesy compliance feature. The platform's scrubbing does not relieve the tenant of TCPA responsibility.
For roofing, paintless dent repair, and auto glass tenants operating in states with specific deductible waiver, solicitation, or insurance-claim regulations (including but not limited to Colorado, Texas, Florida, Illinois, Kentucky, and South Carolina), you attest that your business is properly licensed in each operating state and your business practices comply with applicable state insurance laws.
Powur Dial configures state-specific call script variants during onboarding. Tenants are responsible for ensuring their underlying business operations remain compliant with state law as those laws change.
Setup fee: A one-time setup fee is charged upon onboarding to cover AI agent provisioning, Twilio phone number registration, A2P 10DLC SMS registration, and initial script tuning. Setup fees are non-refundable except as set forth in the Results Guarantee below.
Monthly subscription: Tier-based monthly fees are charged in advance for each calendar month of active service. Storm Standby mode is billed at $99/month while the tenant is in standby. Reactivation from Standby to active is billed at $249 per reactivation.
Overage: Dial volumes exceeding tier caps are billed at the per-dial overage rate listed on the pricing page. Overage charges appear on the next monthly invoice.
Revenue share: Beginning 45 days after the first confirmed appointment booked by the AI, a percentage-of-revenue share (or flat-per-appointment fee for Exterior Services tenants) is invoiced monthly based on closed jobs the tenant reports as having originated from AI-booked appointments. Tenants are responsible for accurate reporting. Each invoice has a 48-hour dispute window during which the tenant may contest specific line items with supporting documentation. Payment is Net-15.
If the platform produces fewer than eight (8) confirmed appointments booked by the AI during the first 45 days of active dialing, the tenant may request a full refund of the setup fee within 14 days of the end of the proof period. Active dialing requires a campaign that is live, with leads loaded, during designated call windows. The guarantee does not apply if the tenant pauses, cancels, or otherwise restricts campaign operation during the proof period.
The first 90 days of active service constitute a results window. The tenant may terminate the subscription with 30 days' written notice at any time after day 90. Termination during the first 90 days is permitted only under the Results Guarantee terms in Section 5.
Powur Dial may suspend or terminate service for cause, including but not limited to violation of these terms, TCPA non-compliance, payment default, or use of the platform for purposes other than legitimate business outreach to lawfully obtained leads.
All calls placed through the platform are recorded for quality assurance, compliance monitoring, and AI script improvement. Call recordings are stored encrypted at rest and retained according to the applicable industry retention period (minimum 12 months, longer for industries with regulatory retention requirements).

Powur Dial provides the platform “as is.” We do not guarantee specific campaign outcomes, conversion rates, or appointment volumes beyond the explicit Results Guarantee in Section 5. The platform's liability is limited to fees paid by the tenant in the prior 12 months.
Tenants assume all liability for campaign content, lead list provenance, and compliance with industry-specific regulations governing their underlying business.
We may update these Terms periodically. Material changes will be communicated to active tenants by email at least 30 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the updated terms.
